ORDER

The petitioner challenges the notice issued under Section 7 of the Land Encroachment Act.

2. When the matter was taken up for hearing, the learned Additional Government Pleader produced the copy of the order passed under Section 6 of the Act on 03.01.2026.

3. Strictly speaking, this writ petition has become infructuous. It is also noted that the authorities have taken action pursuant to the direction given by us in W.P.(MD)No.26003 of 2025 on 25.09.2025. Be that as it may, the 2/4

learned counsel for the petitioner states that if the order under Section 6 is kept in abeyance for a period of three months, the petitioner may make appropriate arrangement in the meanwhile.

4. Recording the undertaking of the petitioner that he would remove the encroachment and ensure free flow of water, we direct that the order passed under Section 6 of the Act shall not be enforced for a period of three months.

5. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
