Mandamus, directing the 1st and 2nd respondents to consider the petitioner's objection to register the property in Survey Nos.1/2 and 2/3 situated at Andarkottaram Village, Madurai District, by considering the petitioner's representation dated 11.12.2025 and pass appropriate orders on merits and in accordance with law within the period that may be stipulated by this Court. ORDER

The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioner's objection to register the property in Survey Nos.1/2 and 2/3 situated at Andarkottaram Village, Madurai District, by considering the petitioner's representation dated 11.12.2025.

2. Learned counsel for the petitioner would submit that the petitioner is the cultivating tenant in the property in the abovesaid survey numbers and respondents 3 to 7 are owners of the said 2/6

property. While so, they intend to sell the subject property to third parties and in that event, the petitioner will be dispossessed. Therefore, the petitioner made objection in respect of registration of the subject property and finding that his representation in this regard dated 11.12.2025 was not considered, the petitioner has filed this writ petition.

Learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the respondents 3 to 7 are owners of the subject property and the petitioner who is the cultivating tenant in the property, has no locus standi to make any objection / representation or to seek any opportunity of personal hearing so as to prevent the sale by the owners at any cost. Further, the right of the petitioner as cultivating tenant cannot be agitated or decided in the writ jurisdiction and the proper course for the petitioner is to approach the civil court.

4. Considering the submissions made by the petitioner as 3/6

well as the respondents 1 and 2, I am of the view that the petitioner being a cultivating tenant in the subject property cannot at any cost prevent the respondents 3 to 7 from selling the subject property to third parties. As rightly pointed out by the learned Additional Government Pleader, the petitioner has no locus to prevent the sale by the owners of the subject property. If at all the petitioner has got any right, he has to establish the same before the competent civil court. I do not find any merit in this writ petition.

5. Accordingly, the Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 05.01.2026 Index : Yes / No bala To
