The above petition has been filed seeking orders to condone the delay of 84 days in filing the second appeal, challenging the judgment and decree passed in A.S.No.93 of 2024 dated 22.04.2025 on the file of the Subordinate Court, Rajapalayam, reversing the judgment and decree made in O.S.No.1039 of 2004 dated 11.12.2017 on the file of the Additional District Munsif Court, Srivilliputtur.

2. Despite receipt of notice, the respondents 2 and 3 have not turned up.

3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

4. The learned counsel appearing for the first respondent would submit that they are leaving to the discretion of the Court.

Considering the facts and circumstances and also the quantum of delay, this Court is inclined to condone the delay.
