PRAYER :- For Anticipatory Bail in Crime No. 29 of 2025 on the file of the respondent police.

ORDER : The Court made the following order :- The 1st petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 498(A) and 406 IPC in Crime No.29 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to matrimonial dispute, he 1st petitioner herein, who is the husband of the defacto complainant, is said to have demanded additional dowry and also harassed her both mentally and cruelly. Hence, the complaint.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police.

4. This Court has already granted anticipatory bail to Petitioners 2 2/8

to 7 vide order dated 19.12.2025 in Crl.O.P.(MD) No. 23786 of 2025 and had also directed the respondents not to arrest the first petitioner. After the grant of interim anticipatory bail, the first petitioner allegedly abused the defacto complainant, and the defacto complainant has relied upon the statements made by the first petitioner on Instagram. This Court has perused the same, and the petitioner's attitude is evident from the said messages. Therefore, this Court directs the first petitioner to file an undertaking affidavit before the Trial Court, at the time of producing sureties, stating that he shall not post any such messages on any social media platform hereafter.

5. Considering the nature of allegations against the first petitioner and that the first petitioner is ready and willing to deposit a sum of Rs. 5,00,000/-, this Court is inclined to grant anticipatory bail to the first petitioner, subject to certain conditions.

6.Accordingly, the first petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the 1st petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten 3/8

Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Madurai, Madurai District, within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a]the first petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; (b) the first petitioner is directed to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.29 of 2025 before the Court concerned, without prejudice to his rights and contentions before the trial Court and produce the receipt / acknowledgment before the concerned Court while executing sureties. On such deposit, the learned Magistrate shall deposit the said amount in an interest bearing Fixed Deposit in any nationalized Bank initially for a period of one year and 4/8

renew them periodically until the final order/Judgment is passed in the case in Crime No.29 of 2025. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment.

(c) Further, the first petitioner shall file an undertaking before the concerned Court stating that he shall not post any derogatory messages against the de facto complainant and the child on any social media platform.

[d] the first petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation;

[e]the first petitioner shall not tamper with the evidence or witness either during investigation or trial. 5/8

[f]the 1st petitioner shall not abscond either during investigation or trial.

[g]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the 1st petitioner in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[h]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
