ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 01.12.2025 and to restore the patta either in the name of Thangavel Pandithar or his legal heirs by removing the names of third parties, which were included without any basis.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that the patta relating to the subject property originally stood in the name of the petitioner's grandfather namely, Thangavel Pandithar, who is the lawful owner,
and thereafter in favour of his legal heirs. Without any notice or legal basis, the names of third parties were wrongly included in the patta, causing serious prejudice to the rights of the petitioner and the legal heirs of Thangavel Pandithar. Hence, the petitioner submitted a detailed representation dated 01.12.2025 to the respondents seeking restoration of the patta in the name of Thangavel Pandithar or his legal heirs by deleting the names of the third parties. Despite receipt of the said representation, the respondents have failed to consider and pass any orders till date. Hence, the present Writ Petition.
4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation will be considered and appropriate orders will be passed on merits and in accordance with law, within a time frame to be fixed by this Court.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 01.12.2025, on merits and in accordance with law and pass appropriate orders after providing
reasonable opportunity of hearing to the petitioner, and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order.
