ORDER

Seeking to direct the respondents 1 and 2 to consider and dispose of the petitioner's complaint dated 15.12.2025, this criminal original petition is filed.

2.The learned counsel for the petitioner submitted that the second respondent instead of considering the petitioner's complaint, has been giving interest to the complainant lodged by the counter petition, namely, Iruka.T.H and Namith and hence, sought for indulgence of this Court in directing the second respondent police to proceed to deal with the complaint lodged by the petitioner on 15.12.2025. 3.Per contra, the learned Government Advocate (crl.side) submitted that the petitioner has already given a complaint before the SIPCOT police station. Instead, the District Crime Branch has been impleaded as second respondent herein. That apart, the learned Government Advocate submitted that the crux of the complaint involves certain import and export issues, which has to be duly dealt with by the Customs Authority. However, no complaint has been received from the 2/5

petitioner so far by the second respondent police. 4.In reply, the learned counsel for the petitioner submitted that already a complaint has been given to the Superintendent of Police, which has been forwarded to the second respondent police. He further submitted that the matter involves an offence under Section 420 IPC in respect to certain acts of forgery allegedly committed by the counterpetitioner. 5.Heard the learned counsel on either side and perused the materials available on record.

6.Considering the fact that the second respondent police has not yet received any complaint from the petitioner either personally or received any papers in this regard from the first responder office, the petitioner is directed to give a complaint afresh to the second respondent police. On receipt of the same, the second respondent shall deal with it in the manner prescribed in the code of criminal procedure and dispose of the same within a period of four weeks thereafter. 3/5

7.With the above direction, this Criminal Original Petition is disposed of.
