ORDER

Seeking to transfer the investigation of case in Crime No.422 of 2025 on the file of the 3rd respondent for the offences under Section 427, 294(b), 506(i) of IPC to the file of the 4th respondent considering the representation, dated 05.12.2025, this criminal original petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner is the defacto complainant. With respect to the theft of nearly more than 100 sovereign gold jewellery in his jewellery shop, which is functioning in the name and style of Pasupathi Jewellery Shop in front of Old Theatre Junction, Marthandam, a complaint was lodged by him 2/6

to the 3rd respondent police on 03.08.2025, for which F.I.R in Crime No.422 of 2025 was registered by the 3rd respondent police. However, there is no progress in the investigation. Hence, this petition.

3. The learned Government Advocate(Crl.Side) on instructions submitted that enquiry is under progress and the enquiry would reveal that no jewellery has been stolen from the petitioner's shop and it has been substantiated from the statement obtained from the staff of the petitioner's jewellery.

4. Heard the learned counsels on either side and perused the materials available on record.

5. Considering the nature of the complaint made by the petitioner, the 3rd respondent is directed to conclude the investigation as expeditiously as possible within a period of one month from the date of receipt of copy of this order and to apprise the 2nd respondent the progress of the investigation every Friday. The 2nd respondent is 3/6

directed to monitor the investigation conducted by the 3rd respondent from time to time till the conclusion of the investigation.

6. With the above directions, this Criminal Original Petition is disposed of.
