Respondents PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, calling for the records relating to the Impugned Order passed by the 2nd Respondent in his vide proceedings in A.NI.THU.NO.9041/2025E1 dated 17.11.2025 in O.A.No.45 of 2024 as Quash the same as illegal and consequently direct 1/5

the 2nd Respondent to furnish the attested copy of the marked documents Ex.P1-22 in O.A.No. 45 of 2024 and pass such other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The prayer in the writ petition is innocuous in nature inasmuch as it prays for a certiorarified mandamus calling for the records in respect of an interim order that is passed on 17.11.2025, whereby the documents in Ex.P.1 to Ex.P.22 were marked, however, the same has not been furnished to the petitioner. Therefore, the petitioner has filed this writ petition to furnish him with the copies.

2. Heard Mr.A.Joseph Jerry, learned counsel appearing for petitioner and Mr.M.Sarangan, learned Government Advocate, who takes notice on behalf of the respondents.

3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

When the matter came up for hearing today, the learned Additional Government Pleader appearing for the respondents would submit that as per the rules, the petitioner being the party to the proceedings will be entitled for the certified copies of the document. However, in this case, the apprehension is expressed only because the document itself are photocopies and there should not be any misuse of the documents.

5. When the petitioner is a party to the proceedings, the documents that are marked should be furnished to him, especially when there is a provision to furnish the certified copy. The mere apprehension that the party may misuse cannot be a ground to deny him the document. 3/5

6. In view thereof, the writ petition is allowed on the following terms:- i. Since the petitioner has already made an application for the copies of Ex.P.1 to Ex.P.22 before the 2nd respondent, the 2nd respondent is directed to provide the certified copies of Ex.P.1 to Ex.P.22 within a period of one week from the date of receipt of a web copy of the order, without waiting for the certified copy of the order. ii. Necessary charges, if any, shall be collected from the petitioner after furnishing the copy.

iii. Further proceedings can be carried on in O.A.No.45 of 2024 in accordance with law.

iv. No costs. Consequently, connected miscellaneous petition is closed.
