J U D G M E N T

The appellant is A4 in Crime No.96 of 2025, on the file of the Aaudayarkovil Police Station, Pudukkottai District. He is facing trial before the Special Court for Exclusive Trial of SC/ST Act cases, Pudukkottai in SC No.32 of 2025. He was denied bail by the trial Court and therefore, the appellant has preferred this Criminal Appeal. 2.The learned counsel appearing for the appellant submits that he has underwent a surgery recently and therefore, he needs a review in a private hospital. According to him, this appellant is in jail for the past seven months.

3.The learned Government Advocate (Crl.side) appearing for the respondents 1 & 2 has raised serious objections that this appellant is a history sheeted rowdy, having five previous cases to his credit. 2/6

That apart, this case is of a double murder. Out of five previous cases, one is a murder case. He also claimed that the trial has already commenced and in the event, if this appellant is released on bail, he may tamper the witnesses and also there may be chances for absconding from the clutches of law. He further submits that the witnesses LWs 1 to 6, 8 & 9 were summoned and at request of this appellant alone, the case in SC.No.96 of 2025 has been adjourned. 4.The learned counsel for the appellant has insisted that the appellant has underwent a surgery on 19.01.2026 and he needs proper medical care. Considering this submission, this Court, by its order, dated, 24.02.2026, has directed the respondent police to ascertain the present medical condition of the appellant and to file a report to that effect. The Professor, Dr.U.

Aravindar, Department of Surgical Gastroenterology, Thanjavur Medical College and Hospital has examined this appellant and reported that he is recovering from his illness and he does not require any admission in the hospital. He requires to have medicine for a period of two weeks.

5.Considering the antecedents of this appellant, the fact that the trial has already commenced and also the fact that the medical grounds raised by this appellant is also negatived by the Doctor of Thanjavur Medical College and Hospital, this Court is not inclined to entertain this Criminal Appeal. Accordingly, this Criminal Appeal is dismissed. Since the bail has been denied to this appellant, the trial Court is expected to give priority to the case in SC No. 96 of 2025 and conclude the trial as expeditiously as possible. 11.03.2026 NCC : Yes / No.
