ORDER

This Civil Revision Petition has been filed seeking for expeditious disposal of H.M.O.P.No.291 of 2023 pending on the file of the learned Subordinate Judge at Musiri.

2.When the matter came up for admission on 04.03.2026, I called for a report from the learned Subordinate Judge, Musiri as to how long, the learned Judge would require to dispose of the said H.M.O.P. The learned Judge has sent a report that as the interim maintenance application is pending, this main H.M.O.P. could not be taken up for disposal.

3.Mr.S.Vashik Ali, learned counsel appearing for the petitioner states that the maintenance application stood allowed as early as on 23.01.2026 and hence, there is no impediment for the learned Judge to proceed further with the trial in H.M.O.P.

4.In the light of the submission made by Mr.S.Vashik Ali as well as the report of the learned Subordinate Judge, the learned Sub Judge, Musiri is requested to dispose of H.M.O.P.No.291 of 2023 within a period of four months from today ie., 11.03.2026. Further, being a proceeding under the Hindu Marriage Act, in case, the husband defaults in payment of maintenance, the learned Sub Judge will suo motu exercise the power to stay the proceedings till the maintenance is cleared. If despite such stay, the amount is not cleared, the learned Sub Judge will 2/4

dismiss H.M.O.P.No.291 of 2023 for non-payment of maintenance. 5.This civil revision petiton is disposed of accordingly. No costs.
