ORDER

This Civil Revision Petition has been filed challenging the fair and ex parte order passed in I.A.No.1 of 2025 in G.W.O.P.No.71 of 2024 on the file of the Principal District Court, Sivagangai, dated 04.12.2025. 1/5

2. The respondent husband filed an application before the Principal District Court, Sivagangai, seeking visitation rights to see the child, namely Janvi Sri, aged about 8 years. The trial Court, taking into consideration the age of the child, granted visitation rights to the respondent / husband to meet the child on every 3rd Sunday between 9.00 a.m. and 12.00 p.m. Challenging the same, the present Civil Revision Petition has been filed.

The learned counsel for the petitioner submitted that when the respondent met the child in the Court premises, the child got frightened and cried loudly, and even after one hour, she did not speak a single word with the respondent. It is further submitted that if visitation rights are granted, it would worsen the health condition of the child due to her fear on the respondent. Hence, she prayed to set aside the order passed in I.A.No.1 of 2025 in G.W.O.P.No.71 of 2024 on the file of the Principal District Court, Sivagangai, dated 04.12.2025.

5. It cannot be disputed that the love and affection of the father cannot be taken away. The Court below has only granted visitation rights to the respondent / father to have the custody of the child from 9.00 a.m. to 12.00 p.m. The application filed by the petitioner wife appears to be vexatious. Dehors the strained relationship between the husband and wife, the love and affection of the father towards the child cannot be taken away for whatever reason stated by the revision petitioner.

6. In view of the above, this Court does not find any merit in this Civil Revision Petition.
