ORDER

(Order of the Court was delivered by DR.G.JAYACHANDRAN, J.) The present writ petition is filed alleging that the show cause notice issued under Section 7 of the Land Encroachment Act, dated 17.10.2025 followed by an eviction notice under Section 6 of the Act dated 09.12.2025, is without basis and there is no encroachment of public land by the petitioner.

2.On the earlier occasion, the learned Additional Government Pleader has been directed to file a report as to whether there is any encroachment by the petitioner as alleged in the impugned order. 2/5

3.The Thasildar, Thiruppuvanam Taluk filed a status report stating that in fact, there is an encroachment of public land by the petitioner herein and he has also mentioned the extent of encroachment in his report.

4.In view of the above fact, we are not inclined to entertain the present writ petition. Accordingly, this writ petition stands dismissed. If the petitioner is aggrieved by the order of the revenue officials under Section 6 of the Act, it is always open to him to prefer a statutory appeal and the dismissal of the present writ petition will not prejudice him in any way from invoking the statutory remedy under the Act. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
