PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to cancel the illegally transferred patta in respect of S.No.290/4A, vide Joint Patta No.11342 standing in the names of the respondents 4 to 9, and to restore Patta No.11251 in favour of the petitioner, based on his representation dated 19.08.2025. ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to cancel the illegally transferred patta in respect of S.No.290/4A, vide Joint Patta No.11342 standing in the names of the respondents 4 to 9, and to restore Patta No.11251 in favour of the petitioner, based on his representation dated 19.08.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 4 to 9, notice to the respondents 4 to 9 is hereby dispensed with.

The learned counsel appearing for the petitioner would submit that the petitioner is the lawful pattadar of the property situated in S.No.290/4A, for which Patta No.11251 stood in his name and all revenue records reflected his lawful possession and enjoyment. Without any notice to the petitioner and without conducting a proper enquiry, the second respondent illegally transferred the patta and issued Joint Patta No.11342 in favour of the respondents 4 to 9, which is arbitrary, illegal, and contrary to the settled principles governing mutation of revenue records. The petitioner has not alienated the said property in favour of the respondents 4 to 9, nor has he consented to the issuance of any joint patta in their favour. Aggrieved by the illegal transfer, the petitioner submitted a detailed representation dated 19.08.

2025 to the second respondent seeking cancellation of the illegally issued joint patta and restoration of Patta No.11251 in his favour. Despite receipt of the said representation, the second respondent has failed to take any action or pass final orders, thereby violating the principles of natural justice and causing serious prejudice to the petitioner.

5. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the petitioner's representation will be considered on merits and in accordance with law, within a time frame to be fixed by this Court.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 19.08.2025, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, the respondents 4 to 9 and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
