ORDER
Seeking direction to the second respondent to provide necessary police protection to the petitioner for conducting survey her property by surveying authorities on the basis of her representation dated 12.12.2025. 2.Considering the limited scope of the prayer sought for, notice to the third respondent is dispensed with.
3.The learned counsel appearing for the petitioner submitted that as per the partition deed effected vide Doc.No.1885/1995 dated 31.07.1995, out of the total extent of 1 acre and 71 cents (0.69 hectare) in Re.S.No.468/2 situated at Thothapanayakanoor Village, Usilampatti Taluk, Madurai District, which originally belonged to the petitioner's parents, the petitioner is entitled to possession and enjoyment to an extent of 53 cents on the western side of the said property. At present, the petitioner submitted an application seeking to survey measuring and fixing boundary stone in respect of her property to the authorities concerned and the authorities have fixed a date and issued notice to conduct the survey. At the time of surveying the petitioner's property, the third respondent, who is none other than one of the petitioner's brother, along with 2/5
his henchmen created law and order problem and obstructed to survey the property without any valid reason. It is the contention of the petitioner that the third respondent is trying to grab the petitioner's property giving false complaint before the second respondent police and he has not produced any document supporting his allegations. Under such circumstances, the petitioner sent a representation on 12.12.2025 to the respondents 1 and 2 seeking to provide adequate police protection at the time of surveying her property. It is further submitted that in the representation sent by the petitioner, her name was wrongly mentioned as Valliyammal, instead of Vallirani and the same error was also informed by the petitioner to the respondents 1 and 2 by sending clarification representation dated 18.12.2025. However, the same has not been considered so far. Hence, the petitioner has approached this Court. 4.The learned Government Advocate appearing for the respondent police submitted that the representation of the petitioner will be considered within a time to be framed by this Court.
5.Considering the facts and circumstances of the case, this Court directs the respondents 1 and 2 to consider the representation of the petitioner dated 12.12.2025 and 18.12.2025 and afford police protection to the petitioner. The 3/5
petitioner shall also be liable to pay the necessary charges for availing police protection in terms of G.O.(Ma).No.139, Home (Pol-VIII) Department, dated 04.03.2019 and the respondent police is directed to provide the required protection on the specified date upon receipt of such payment. Accordingly, this Criminal Original Petition stands allowed.
