PRAYER : Petition filed under Section 528 of BNSS, 2023 to direct the 1st respondent to transfer the investigation in Crime No. 751 of 2025 on the file of the 4th respondent police station to the 5th respondent, and consequently direct the 5th respondent to complete the investigation and file a final report before the concerned jurisdictional court within a time frame fixed by this Court. ORDER
The petitioner seeks for a direction to transfer the investigation in Crime No. 751 of 2025 on the file of the 4th respondent police to the 5th respondent, and consequently direct the 5th respondent to complete the investigation and file a final report before the concerned jurisdictional Court within a time frame fixed by this Court.

The learned counsel for the petitioner submitted that all the accused persons are officers of the Police Department, with respect to an alleged attack carried out against the petitioner and his family, on 01.11.2024 at about 08:40 pm. In this regard, a complaint was made before the 4th respondent police. However, the police failed to register an FIR based on the said complaint. 2/7
Aggrieved by the inaction on the part of the respondent police, the petitioner was constrained to file a petition in Crl.M.P. No.84 of 2025 before the Special Court for the Prevention of Atrocities against Scheduled Castes and Scheduled Tribes, seeking appropriate directions. The Special Court passed an order on 18.11.2025 directing the 4th respondent to register an FIR. Complying with the said direction, the 4th respondent registered a case in Crime No.751 of 2025. However, the investigation is not progressing even after the lapse of one year and hence, sought for transfer of investigation.

The learned Government Advocate appearing for the respondent police submitted that the FIR in Crime No.751 of 2025, which was registered against the petitioner, came to be registered at the instance of the Sub-Inspector of Police, who had visited the petitioner's place on the fateful day upon receipt of a call from the 100 emergency number from the petitioner's neighbour, alleging a tussle between the petitioner and the said neighbour. The petitioner gave a complaint as against the police officers, at the time when the SubInspector of Police intervened in the ongoing dispute between the petitioner and his neighbour. Even the petitioner had quarreled with the same SubInspector, following which the Sub-Inspector gave a complaint against him. For which an FIR in Crime No.148 of 2024 came to be registered as against the 3/7
petitioner. Only to counter blast the same, he had made an application before the Special Court on whose direction FIR came to be registered as against the police officers and there is not even an iota of evidence in the petitioner's version and sought for dismissal of this petition.
4. Heard the learned counsel on either side and perused the materials placed before this Court.

Considering the nature of the offences involved, the investigation in Crime No.751 of 2025 is transferred from the file of the fourth respondent, to the Deputy Superintendent of Police, Kanyakumari Zone, Kanyakumari District and the Deputy Superintendent of Police, Kanyakumari Zone, Kanyakumari District is directed to conclude the investigation as expeditiously as possible within a period of three months from the date of receipt of a copy of this order.
