ORDER

The present miscellaneous petition is filed seeking extension of time to comply with the order dated 05.04.2019, wherein this Court in Crl.RC(MD)No.117 of 2019 had directed release of vehicle subject to the following conditions:- "Accordingly, this petition is allowed and the order of the learned Judicial Magistrate No.2, Karur in Crl.M.P.No.5972 of 2018 is set aside and the learned Magistrate is directed to return the vehicle subject to the petitioner on the following conditions:- (a)The petitioner shall deposit the original Registration Certificate of the vehicle;

(b)The petitioner shall deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the credit of Crime No. 287 of 2018, within a period of one week from the date of receipt of a copy of this order;

(c) The petitioner shall not make any alteration of the vehicle; (d)The petitioner shall produce the same before the Court as and when required."

2. In the said order, petitioner was directed to deposit a sum of Rs.25,000/- to the credit of Crime No.287 of 2018, within a period of one week from the date of receipt of a copy of the order. However, he had not complied with the same and had filed a petition for extension of time in 2020.

3. This Court vide order dated 15.07.2020, extended the time by a further period of one month from 15.07.2020, which expired on 15.08.2020. It has been more than six years since, petitioner failed to comply with the order.

4. Petitioner has once again filed a petition seeking extension of time, stating that non-compliance of the said order is due to the fact that he was diagnosed with lymphnode and had to incurred huge medical expenses in treatment. He submits that this vehicle is the only source of his livelihood.

5. Considering the exceptional circumstances and peculiar facts of the case, this Court permits the petitioner to deposit a sum of Rs.25,000/- to the credit of Crime No.287 of 2018, within a period of one week from the date of receipt of a copy of this order.
