ORDER

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Thirumangalam, to dispose of the Cr.M.P.No.3518 of 2022 in M.C.No.21 of 2016 within the time as fixed by this Court. 1/4

The learned counsel for the petitioner submitted that the petitioner, the aggrieved party in M.C.No.21 of 2016, seeks to dispose of the case in Cr.M.P.No.3518 of 2022 in M.C.No.21 of 2016 on the file of the the learned Judicial Magistrate, Thirumangalam, due to undue delays. The petitioner has filed a maintenance case, in which, the respondent was directed to pay a sum of Rs.3,500/- per month to the petitioner as monthly maintenance and it was also ordered that the said sum to be paid by the respondent on or before every month of 5th day of English Calendar in person or through bank account of the petitioner. However, the respondent failed to comply the said order. Due to which, the petitioner is facing financial crisis. Hence, the petitioner filed Cr.M.P.No.3518 of 2022 in M.C.NO.21 of 2016 seeking enforcement of order passed in the maintenance case. It is the grievance of the petitioner that the said case has not been disposed of so far. Hence, the petitioner is before this Court.

Considering the nature of the case, notice to the respondent is dispensed with and also this Court directs the learned Judicial Magistrate, Thirumangalam, to dispose of the case in Cr.M.P.No.3518 of 2022 in MC No. 21 of 2016 as expeditiously as possible preferably within a period of one month from the date of receipt of a copy of this order. 2/4
