This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to complete the enquiry Page No. 1 of 5
proceedings in Na.Ka. No.A4/1800/2022 within the time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioner is that the properties comprised in S.Nos.634/3C, 634/3B and 635/1A, situated at Alangulam Village, belonged to the petitioner's father, who has since died, leaving behind five legal heirs, including the petitioner. Though the petitioner is entitled to a 1/5th share in the said properties, the petitioner's siblings have sold the properties to third parties by suppressing the petitioner's share. Based on the said sale deeds, the revenue officials mutated the revenue records and subdivided the lands.
4. Therefore, the petitioner submitted a petition dated 23.03.2022 to the first respondent seeking cancellation of the subdivision. The first respondent took the said petition on file in Na.Ka. No.A4/1800/2022 and forwarded the same on 10.04.2022 to the second respondent for conducting an enquiry and submitting a report. However, no further action Page No. 2 of 5
has been taken by the respondents. The second respondent, vide a communication dated 27.03.2025, informed the petitioner that the report had already been sent to the first respondent. However, no further action has been taken by the first respondent. Hence, the petitioner has been constrained to file the present Writ Petition.
5. The learned Government Advocate appearing for the respondents, on instructions, would submit that the enquiry on the petitioner's petition would be completed and appropriate orders would be passed by the first respondent within a period of twelve weeks.
6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to conclude the enquiry on the petitioner's petition and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, her siblings and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to Page No. 3 of 5
pursue their remedies before the competent Civil Court. There shall be no order as to costs.
