Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to take legal action as against the erring officials of the third respondent office and the fourth respondent and his associates and further direct the first respondent to take departmental action as against the erring officials of the third respondent office.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the second respondent to take legal action as against the erring officials of the third respondent office and the fourth respondent and his associates and further direct the first respondent to take departmental action as against the erring officials of the third respondent office.

2.The contention of the petitioner is that he filed a suit in O.S. No. 266 of 2022 before the Sub Court, Ramanathapuram, seeking partition, wherein the fourth respondent is one of the defendants and a co-sharer. The allegation against the fourth respondent is that, during the pendency of the suit, he sold the property, including the petitioner's share.

Therefore, the petitioner preferred a complaint before the second respondent. Since no action has been taken against the fourth respondent, the present petition has been filed.

3.The learned Government Advocate (Crl. Side) appearing for the second respondent Police submitted that he has not received any complaint but, the petitioner has only issued a legal notice. He further submitted that there is a prescribed format and procedure for filing a complaint, which must be followed after paying the requisite fee. The complaint should be lodged through the online portal. 4.As the learned Government Advocate (Civil Side) appearing for the respondents 1 and 3 submitted the complaint should be received through online on payment of the requisite fee. 5.Recording the submissions made on either side, this Court directed the petitioner to submit a fresh complaint on payment of the requisite fee through online. If such a complaint is received, the same shall be considered in accordance with law. However, the petitioner is

also directed to approach the civil court, where the suit is pending, to obtain an ad interim injunction or stay, if so advised. 6.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
