ORDER

This writ petition has been filed seeking a direction to the respondents 1 and 2 to issue the death certificate of petitioner's brother, Palaniappan, S/o.Muniappa Goundan, who expired on 09.12.2023, based on the petitioner's representation dated 22.01.2024. 2.It is the case of the petitioner that her brother, Palaniappan, died interstate on 09.12.2023 and the same was inadvertently not registered. Hence, the petitioner made a representation requesting the issuance of the death certificate of his brother. However, the said request has not been considered till date. Therefore, the petitioner has filed this Writ Petition.

3. The learned Government Advocate appearing for the respondents submitted that the petitioner had submitted a representation to the Village President, Mavathur Village. Based on the said representation, the respondents cannot take any steps to issue a legal heir certificate unless a representation is given to the respondents. He further submitted that the petitioner had stated that his brother passed away one 2/4

year ago. However, as per the official records, the said person passed away eight years ago. In any event, if a fresh representation is given along with all necessary details, the same would be considered in accordance with law.

4.In view of the above submissions, without expressing any opinion on the merits of the matter, this Court directs the petitioner to submit a fresh representation to the respondents along with all necessary details. On receipt of such representation, the respondents shall consider the same and pass appropriate orders on its own merits and in accordance with law within a further period of eight weeks, from the date of receipt of the representation.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
