ORDER

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus, to quash the impugned order dated 04.12.2025 passed in Na.Ka.No.C4/336/32604/2024 by the 1st Respondent.

2. Heard the learned counsel on either side.

3. The petitioner was in possession of a license bearing No.LN315997A20C19(AM/07/TRC/2013) and the same was cancelled, through the impugned order. Challenging the impugned order the petitioner has filed this Writ Petition.

The respondents have filed a counter stating that the petitioner was involved in a crime in Crime No.156 of 2023 dated 09.03.2023 for the offences under Section 153 IPC and Section 4A(1)(b) read with Section 4B of the Tamil Nadu Open Places (Prevention of Disfigurement) Act, and there are totally three accused. 2/4

5. It is seen that the said F.I.R was filed against the petitioner based on some agitation, the F.I.R was filed against the petitioner. The allegation against the petitioner is that he had quarreled with the temple authorities and damaged the flex board. This Court is of the considered opinion that the same cannot be the reason to cancel the license. Since the petitioner has not misused to the Pistol and shall not violated the Arms Act and hence, the respondents cannot be cancelled the license.

6. In view of the same, the impugned order passed by the first respondent is hereby quashed. The respondents are directed to renew the petitioner's license within a period of four weeks from the date of receipt of a copy of this order.

7. Accordingly, this Writ Petition is Allowed. Consequently, connected Miscellaneous Petition is closed.
