respondent in connection with property comprised in Survey No.381/2 to an extent of 0.32.00 Hectares situated at Uthumalai Revenue Village, Veerakeralam Pudur Taluk, Tenkasi District and restore the same, on the basis of the petitioner's representation dated 01.12.2025 within time frame stipulated by this Court.

O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to fourth respondents to cancel Patta No. 5755 issued in favour of the eighth respondent in respect of the property comprised in Survey No.381/2, situated at Uthumalai Revenue Village, Veerakeralam Pudur Taluk, Tenkasi District and to restore the same by considering the petitioner's representation dated 01.12.2025 within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The grievance of the petitioner is that the subject property belongs to him. According to the Survey Land Register, the said property stood in the name of the petitioner's father. Though the petitioner's father's real name is Nagoor Meera Maideen, he was also known as Nagoorkani Maraikayar @ Nagoor Shayabu @ Nagoor Meera Maideen as nicknames. One Ibrahimmushu, taking advantage of the similarity in the names of the petitioner's father and his own father, namely, Nagoor Kani, forged documents and executed a sale deed in favour of the fifth to seventh respondents. Based on the said sale deed, the fifth to seventh respondents got their names entered in the revenue records and obtained patta in their favour.

4. The petitioner submitted several representations. However, no action was taken thereon. Therefore, the petitioner filed a writ petition in W.P.(MD) No.24025 of 2025 before this Court seeking a direction to consider his representation for cancellation of patta. This Court, by order dated 08.09.2025, directed the third respondent herein to consider the petitioner's request and dispose of the representation. Thereafter, the petitioner submitted another representation dated 31.10.2025. Pending consideration of the said representation, the fifth to seventh respondents Page No. 3 of 6

executed a sale deed in favour of the eighth respondent, based on which the patta was transferred in his name. Thereafter, the petitioner submitted yet another representation dated 01.12.2025 to the first to fourth respondents. Since the first to fourth respondents have not taken any action on the petitioner's representations, the petitioner has filed the present writ petition.

5. The learned Government Advocate appearing for the first to fourth respondents would submit that the petitioner's representation dated 01.12.2025 would be considered and appropriate orders would be passed by the third respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 01.12.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the private Page No. 4 of 6

respondents and any other interested parties who may be affected by such decision before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
