ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(B), 397 and 506(2) of IPC, in S.C.No.298 of 2024 in Crime No.90 of 2024, seeks anticipatory bail.
2. The case of the prosecution is that the trial Court is said to have issued a non-bailable warrant against the petitioner. Hence, the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent Police submitted that it is a case of jumped bail. He further submitted a non-bailable warrant was against the petitioner. Therefore, 2/4
he opposed for grant of anticipatory bail to the petitioner.
5. Considering the fact that the petitioner has jumped bail, this Court is not inclined to grant anticipatory bail. The petitioner is directed to surrender before the concerned Court and file a recall application. On such application, the concerned Court shall consider the same in accordance with law on merits on the same day.
6. With the above said directions, this Criminal Original Petition is disposed of.
