2026-06-16Honourable Mr Justice N. Anand Venkatesh,Honourable Mr Justice K.K. Ramakrishnan1 pages

C.M.P.(MD).No.5703 of 2026 in CMA(MD).SR.No.111402 of 2025 N.ANAND VENKATESH, J.

and K.K.RAMAKRISHNAN, J.

This petition has been filed to condone the delay of 53 days in filing the above Civil Miscellaneous Appeal against the order passed by the Appellate Tribunal under SAFEMA in FPA-PMLA-1645/CHN/2017, dated 28.08.2025.

2. A counter affidavit has been filed by the first respondent opposing this petition on the ground that the delay has not been properly explained and a wrong provision has been invoked by the petitioner.

3. This Court heard the learned counsel on either side.

4. Considering the period of delay in filing the appeal and also taking note of the fact that the mere wrong mentioning of the provision cannot take away the right of a person, we are inclined to condone the delay.

5. Accordingly, this petition is allowed and delay is condoned.
