PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No.544 of 2025 on the file of the respondent police ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 13.12.2025 for the offences punishable under Sections 3(5), 296(b), 109(1), 351(3) of BNS and Section 25(1A) of Arms Act, in Crime No.544 of 2025 on the file of the respondent police, seek bail.

The case of the prosecution is that on 13.12.2025, at about 4.00 p.m., while the respondent police were checking vehicles near Kootampuli Bridge, the petitioners were travelling from north to south in a car bearing Registration No.TN-69-J-5512. When the respondent police attempted to stop the said vehicle, the petitioners allegedly failed to stop and fled from the spot. Thereafter, the respondent police chased the vehicle and apprehended the petitioners. It is further alleged that during the course of enquiry, the petitioners attempted to attack the police with weapons, and two aruvals and two knives were recovered from them. 2/7

Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent person and they have not committed any offences as alleged by the prosecution. He further submitted that the petitioners are in judicial custody from 13.12.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the offences committed by the accused are serious in nature. Therefore, he opposed for grant of bail to the petitioners.

5. The allegation against the petitioners is that they were using deadly weapons and had posted photographs while attending an engagement function. The prosecution circulated certain photographs. On perusing the same, this Court was shocked to see such youngsters posing with such unwarranted weapons during engagement function. It is further submitted that A-5 is a kabaddi champion and is studying at Pope's College, Thoothukudi District. Considering the age of the petitioners and 3/7

also considering the period of incarceration suffered by the petitioners, this Court is inclined to grant bail to the petitioners, subject to the following conditions:

Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Thoothukudi, and on further conditions that :- [a] the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity.

[b] the first petitioner shall stay at Madurai and report before the Inspector of Police, Thallakulam Police Station, Madurai; the second petitioner shall stay at Trichy and report before the Inspector of Police, Cantonment Police Station, Trichy; the third petitioner shall stay at Ramanathapuram and report before the Inspector of Police, Town Police Station, Ramanathapuram; the fourth petitioner shall stay at Sivagangai and report before the 4/7

Inspector of Police, Town Police Station, Sivagangai; the fifth petitioner shall report before Inspector of Police, Sawyerpuram Police Station, Thoothukudi; and the sixth petitioner shall stay at Dindigul and report before Inspector of Police, Town South Police Station, Dindigul, daily at 10.30 a.m., until further orders. No relaxation shall be considered for the next two months.

[c] the petitioners shall not tamper with the evidence or witness either during investigation or trial. [d] the petitioners shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
