ORDER : The Court made the following order :- The petitioners/A7 and 8, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 318(4),61(2)(a),316 and 3(5) of BNS in Crime No.71 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that during 2023 June, on seeing the advertisement made by the Conti Trainers Private Limited and Conti Captial Associates the defacto complainant invested the money in the associates and the same was swindled by the accused persons . Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent and a false case has been foisted against them. The petitioners have has nothing to do with the alleged crime. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned counsel appearing for the intervenor vehemently objected to grant anticipatory bail to the petitioners stating that the accused 2/6

persons has cheated the defacto complainant by not paying the money and amount involved in this case is very huge.

The learned Additional Public Prosecutor would submit that the accused persons had cheated the victims to the tune of Rs.8,09,00,000/- The amount involved in this case is very huge and the offence committed by the accused is grave in nature. He would further submit that investigation is pending. Hence, he opposes to grant anticipatory bail to the petitioner.

6. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the considering the fact that the petitioners are not named accused and the fact that the petitioners are neither Director not involved in the business transactions and also the fact that no previous case is pending against the petitioner and even according to the case of prosecution A1 only identified the plot and no previous case is pending against the petitioner and also the fact that the date of occurrence is 08.11.2022 and the First Information Report has been registered on 10.12.2025 with a delay of three years this Court is inclined to grant anticipatory bail to the petitioner, subject to the 3/6

following conditions:

[a] Accordingly, the petitioners are ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai and on further conditions that: [b] the petitioners shall report before the respondent police, daily at 10.30 a.m., until further orders. [c] the petitioners shall not commit any offences of similar nature.

[d] the petitioners shall not abscond either during investigation or trial.

[e] the petitioners shall not tamper with evidence or witness either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala 4/6

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
