This writ petition has been filed for a mandamus to forbear the respondents, their men, agents or anyone acting on their behalf from laying any road or in any manner interfering with the petitioner's peaceful possession and enjoyment of the patta lands bearing Survey Nos. 1316/3A, 1316/6, 1315/2, 1315/4 and 1314/5, Mallapuram Village, Guziliamparai Taluk, Dindigul District.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

The learned counsel for the petitioner submits that the lands in S.Nos.1316/3A, 1316/6, 1315/2, 1315/4 and 1314/5, Mallapuram Village, Guziliamparai Taluk, Dindigul District, were purchased by the petitioner vide sale deed dated 12.10.2001. From the date of purchase, the petitioner is in possession and enjoyment of the said land, the revenue records were also mutated in his name and he is also paying necessary taxes. Out of the total extent of 7 acres and 60 cents, the petitioner sold 5 acres and 58 cents to one Selvaraj and the remaining 2 acres and 2 cents was with the petitioner. While so, the respondents are attempting to lay a road in the patta land of the petitioner without following due process and without any acquisition whatsoever in the manner known to law.
4. However, the learned Additional Government Pleader appearing for the respondents would submit that before laying any road, survey would be conducted on giving notice to the petitioner and others, if any.
5. It is to be noted that it is the stand of the respondents that before laying any road, survey would be conducted and necessary notice would be issued to the parties concerned. The petitioner has also agreed for the same.
