ORDER : The Court made the following order :- The petitioner/Accused No.4, who apprehends arrest at the hands of the respondent police for 1/7

the offences punishable under section 25(1A) of Arms Act, 1959, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that on 25.11.2025 at about 11.40 a.m, near Vishlakshipuram 1st street, in 2 two wheelers, all the accused persons came in a rash and negligent manner. The respondent Police surrounded the two wheeler bearing registration No.TN 64 S 6291 and arrested the accused Nos.1 and 2 for having two swords with intention to commit crime. The accused Nos.3 and 4 fled away from the scene of occurrence. Hence, the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is an innocent and is falsely implicated in this case. He has not committed any such offences as alleged by the prosecution. He further submits that the co2/7

accused were released on bail by the Principal Sessions Court, Madurai, in Cr.M.P.Nos.5809 and 5897 of 2025, vide orders dated 15.12.2025 and 19.12.2025 respectively. Further, the petitioner is ready to abide by any conditions to be imposed by this Court. He therefore prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would submit that on the day of occurrence, the co-accused stated that they were armed with deadly weapons and threatened to attack the persons if they were approached. Hence, he prayed for dismissal of this Criminal Original Petition.

5. Considering the facts and circumstances of this case and considering the fact that co-accused were enlarged on bail by the concerned Court, this court is inclined to grant anticipatory bail to the petitioner with certain 3/7

conditions:

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.II, Madurai, on condition that the petitioner shall execute separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:

[a] the petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank Pass Book to 4/7

ensure their identity.

[b] the petitioner shall report before the respondent Police daily at 10.30a.m.until further orders.

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[d] the petitioner shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS 2023.
