PRAYER: The Criminal Appeal is filed under Section 378 of Cr.P.C to set aside the judgment of the learned Judicial Magistrate No.III, Madurai District to set aside the judgment of the learned Judicial Magistrate No.III Madurai District in STC No.904 of 2004 dated 26.11.2008 and punish the respondent/accused in accordance with law.

JUDGMENT
The present Criminal Appeal has been filed to set aside the judgment of the learned Judicial Magistrate No.III Madurai District in STC No.904 of 2004 dated 26.11.2008 and punish the respondent/accused in accordance with law. 1/3
2. The learned counsel for the appellant would submit that he has handed over the entire bundle to the appellant along with all papers and even till today the appellant had failed to acknowledge the same and he has not engaged any counsel to represent on his behalf, it shows that the appellant has no interest to pursue with the case, since the appeal is against the acquittal for the offence under section 138 of the N.I.Act.
