JUDGMENT

When the matter was taken up for hearing on 21.04.2023 learned counsel for the appellant has filed a memo of instruction stating that despite giving communication to his client, there is no response from him and reported 'no instruction'. Hence this Court directed the Registry to remove the name of the counsel for the appellant and print the name of the appellant. Today there is no representation for the appellant. The appeal is in the year 2000. Despite sufficient opportunity given to the appellant, the appellant has not come forward to prosecute the appeal. Therefore, this Second Appeal is dismissed for non2/4

prosecution with costs of Rs.1,00,000/- (Rupees One Lakh only) payable by the appellant to the Registry.
