PRAYER: Second Appeal filed under Section 100 of the Civil Procedure Code, against the judgment and decree, dated 5.7.2001 passed by the SubCourt, Kuzhithurai in A.S.No.88 of 1995 reversing the judgment and decree dated 22.03.1995 passed by the District Munsif Court, Kuzhithurai in I.A.No.984/1982 in O.S.No.59 of 1971.

J U D G M E N T

It is represented that sole appellant died long back. The learned counsel for the appellant has not taken any steps to bring on record the legal representative of the deceased sole appellant. Once the sole appellant died, if steps have not been taken within 90 days, the appeal will be abated automatically.

2. In this case, till date no steps have been taken and hence, this appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petitions are closed.
