JUDGMENT
The Second Appeal is of the year 2002. The learned counsel appearing for the appellant elevated to the Bench and accordingly, notice was served on the appellant. In spite of the service of notice, neither the appellant engaged counsel nor appeared before this Court. Under those circumstances, for want of representation on behalf of the appellant, the matter was directed to be listed today under the caption "for dismissal". In spite of the same, the matter is being listed today under the caption for dismissal, there is no representation for the appellant. In the circumstances, this Court is left with no other option except to dismiss this Second Appeal for non prosecution.
2. Accordingly, the Second Appeal is dismissed for non prosecution. No costs.
