JUDGMENT

When the matter is taken up for hearing today, the learned counsel appearing for the appellants is not ready to proceed with the matter, despite sufficient opportunity given to him. The appeal is pending from the year 2002. Therefore, this Second Appeal is dismissed for non-prosecution with costs of Rs.1,00,000/- (Rupees One Lakh only) payable by the appellants to the Registry. In case the appellants have filed any application to restore the appeal, Registry is directed not to take the application on file unless the appellants deposit the said amount imposed by this Court.
