JUDGMENT

It is stated by the learned counsel on either side that the sole appellant passed away in the year 2012 itself. However, no steps have been taken as on date to bring on record Legal Representatives of the deceased sole appellant. Further, the first respondent reported to have died and the same was taken note of this Court on 21.03.2011. However, no steps have been taken even for the deceased first respondent.

2. In view of the death of the sole appellant and failure to bring on record the Legal Representatives of the deceased sole appellant, this Second Appeal is already abated long back. In the circumstances, the same is taken note of and the Second Appeal is dismissed as abated. No costs.
