Civil Miscellaneous Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to restrain the respondents by an order of injunction from alienating or encumbering the subject matter of litigation in O.S.No.135 of 1997 on the file of the District Munsif cum Judicial Magistrate, Papanasam pending disposal of the above appeal. Prayer in SA No.837 of 2004 :
To set aside the decree and judgment of the Principal Subordinate Judge, Kumbakonam passed in A.S.No.136 of 2002 dated 11.04.2003 confirming the decree and judgment of the District Munsif cum Judicial Magistrate, Papanasam passed in O.S.No.135 of 1997 dated 15.03.2002.
ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.K.VIJAYARAGHAVAN, Advocate for the petitioner, the court made the following order:- The Petitioners seek for an order of injunction restraining the respondents from alienating the subject-matter property of the suit in O.S.No.135 of 1997, on the file of District Munsif-cum-Judicial Magistrate Court, Papanasam, pending disposal of the above appeal.
