O R D E R

The petitioner is the Mutawalli of the petition-mentioned mosque. The mosque is owning properties. The second respondent is said to be a tenant occupying the same. Dispute has arisen between the petitioner and the tenant. The petitioner has filed civil suits against the tenant for recovery of possession and for other reliefs. In the meanwhile, Wakf Board is said to have passed the impugned order directing the tenant to pay the rental arrears to the writ petitioner. The petitioner has contended that this order was passed without notice to him.

2. I do no want to go into the merits of the matter. This is for more than one reason. The second respondent is yet to be served. The petitioner' counsel is not having instructions regarding the current position.

3. I therefore dispose of the writ petition by making it clear that the impugned order will not have any bearing whatsoever on the civil proceedings initiated by the writ petitioner against the 2/4

3 W.P.NO.8663 OF 2014 tenant. The civil Court will independently decide the issue on its own merits. The order impugned in this writ petition will not be relied upon to the prejudice of the writ petitioner. This writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
