JUDGMENT

This Second Appeal has been filed against the judgment and decree dated 22.03.2004 on the file of the Principal District Judge, Thanjavur as confirmed the judgment and decree dated 08.03.2001 passed in O.S.No.74 of 1997 on the file of the Principal Subordinate Judge, Thanjavur.

2. When the matter was taken up for hearing, the learned counsel appearing for the appellant submitted that the sole appellant died before three months and steps have not been taken within the period of limitation as stipulated.

3. In view of the above, this Second Appeal is dismissed as abated. No costs.
