The learned counsel appearing for the appellant would submit that the appellant was the cultivating tenant under the Balathandayuthabani Swami Thirukovil, Palani. Now, the matter has become infructuous as the appellant, who was cultivating tenant, has handed over the possession to the Balathandayuthabani Devasthanam and he has also made an endorsement to that effect.

2. In view of the above, this second appeal is dismissed as infructuous. No costs.
