PRAYER: Application filed under Order 47 Rule 1 r/w Section 114 of C.P.C., to review the order dated 17.06.2014 passed in W.A.(MD)No.1080 of 2011 by this Court and affirm the Writ Petition order and consequently, to direct the respondents 3 and 4 to appoint the applicant / 1st respondent / writ petitioner to the post of Library Assistant with effect from the date on which the appellant was appointed with all the benefits as per the rules and regulations of Tamil Nadu Private College Act and Rules.

For Petitioner : No Appearance For R1 & R2 : Mr.J.Ashok, Additional Government Pleader

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Review Application has been filed to review the order of this Court dated 17.06.2014 made in W.A.(MD)No.1080 of 2011, wherein this Court has passed the following order:- "13.In view of our judgment in the writ appeal, M.P.No.2 of 2014 in W.A.(MD)No.SR56209 of 2013 is dismissed. It is submitted that there are number of sanctioned post for which, the first respondent is fully qualified. The fourth respondent shall consider the first respondent / petitioner in W.P.(MD)No.9610 of 2010 in any one of the sanctioned post. The Management of the College may also 2/5

consider the petitioner / Appellant / Third Party S.Meenakshi in W.A.No.SR56209 of 2013 for absorption in any other approval for such selection for appointment."

2.This review application filed by the applicant shows that the grounds raised are relating to merits of the case, which were already adjudicated by the Division Bench of this Court. The scope of the review petition cannot be expanded for re-adjudication of merits already considered by the Court. Only in the event of establishing an error apparent on record, the review petition is entertainable but not otherwise. In the present case, the grounds for review are relating to merits. Therefore, this Court do not find any reason to interfere with the order of this Court date.d 17.06.2014 passed in W.A.(MD)No.1080 of 2011 Accordingly, this Review Application is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
