PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order made in No.648/2024 dated 27.11.2024 passed by the 5th respondent and quash the same illegal and consequently to direct the 5th respondent to register the sale deed presented by the petitioner on 26.11.2024 by considering his representation dated 02.12.2024. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the impugned ordere dated 27.11.2024 passed by the 5th respondent and consequently to direct the 5th respondent to register the sale deed presented by the petitioner on 26.11.2024 by considering the petitioner's representation dated 02.12.2024.

2. In the impugned order, the 5th respondent has relied on the circular dated 08.11.2023 issued by the Director of Registration.

3. According to the petitioner, the circular is not relevant to the issue of registration. It pertains only to increasing the revenue of the Registration Department and therefore, it cannot be cited as a ground for refusing registration. 2/5

4. After hearing the rival submissions, this Court is of the considered opinion that the reasoning stated in the impugned order reflects a total non-application of mind because there is no proper reason at all.

5. Accordingly, the impugned order dated 27.11.2024 passed by the 5th respondent is hereby quashed. The 5th respondent is directed to register the document within a period of four weeks from the date of receipt of a copy of the order.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
