ORDER

This writ petition has been filed seeking for a mandamus to direct the respondents 1 to 3, to remove the drainage ditch made by the respondents in Old S.No. 520, New S.No. 97/1A1A, situated in Palayamkottai Taluk, Tirunelveli District under the guise of putting up underground drainage and direct them to restore the damaged fencing in the petitioner's property.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. Without expressing any opinion on merits of the writ petition, the first respondent is directed to consider the representation submitted by the petitioner by conducting an enquiry after issuance of notice to the petitioner and the second respondent and pass orders on merits and in 2/4

accordance with law, after giving an opportunity to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order,

4. With the above direction, the writ petition stands disposed of. No costs.
