ORDER

This criminal miscellaneous petition has been filed seeking to suspend the sentence imposed against the petitioner by the learned Principal Special Judge, Principal Special Court for EC and NDPS Act Cases, Madurai in C.C.No.52 of 2015, dated 19.12.2023.

2.When the matter is taken up for hearing today, there is no representation for 1/3

the petitioner.

3.The petitioner was found guilty for the offence under Sections 8(c) r/w 20(b) (ii)(C) of NDPS Act and was convicted and sentenced to ten years rigourous imprisonment. The appeal preferred by the petitioner in Crl.A(MD)No.121 of 2025 has already been admitted by this Court on 29.01.2025 and this application is filed to suspend the sentence imposed as against him.

4.When this application was taken up for hearing on 07.02.2025, there was no representation for the petitioner. Therefore, the registry was directed to list this application today. Even today, there is no representation for the petitioner. 5.Considering the nature of offence, this Court is not inclined to suspend the sentence imposed as against the petitioner.
