PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent Chief Educational Officer herein to approve forthwith the appointment of M.Anantha Murthi as Night Watchman w.e.f 20.01.2021 in the petitioner's School namely, St. Michael's Girls Higher Secondary School, Tenkasi and disburse the grant-in-aid towards his salary with all attendant benefits from the said date.

O R D E R

The instant writ petition has been filed by the management of aided minority institution, seeking a mandamus as against the third respondent to approve the appointment of one M.Anantha Muthu as Night Watchman.

2. A perusal of the records reveal that the one M.Anantha Muthu was appointed as Night Watchman in the petitioner's school with effect from 20.01.2021. The management has forwarded the proposal to the third respondent on 11.03.2021. So far orders have not been passed by the third respondent, the present writ petition has been filed. 2/4

3. Heard both sides and perused the records.

4. Though, proposal was forwarded from the fourth respondent to third respondent on 05.08.2021, so far the third respondent has not passed any orders. In view of the above said facts, the third respondent is directed to pass orders on the proposal submitted by the management on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this writ petition is disposed of. No costs.
