PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to challenge the impugned order in Na.Ka.No. 20/ ThaNaCMaMa / 2024 dated 13.06.2024 passed by the 4th respondent and quash the same and consequently to direct the 4th respondent to register the petitioner's name as Traditional Siddha Practitioner and to issue certificate.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to challenge the impugned order in Na.Ka.No. 20/ ThaNaCMaMa / 2024 dated 13.06.2024 passed by the 4th respondent and consequently to direct the 4th respondent to register the petitioner's name as Traditional Siddha Practitioner and to issue certificate.

2. In the impugned order, the respondents have stated that, as per the provisions of the Tamil Nadu Siddha System of Medicine (Development and Registration of Practitioners) Act, 1997, there is no possibility of entering the petitioner's name.

3. The Learned Counsel appearing for the petitioner brought to the notice of this Court that under Sections 2(14) read with 34 of the Tamil Nadu 2/5

Siddha System of Medicine (Development and Registration of Practitioners) Act, 1997, a schedule has been incorporated. As per the schedule even privately practicing persons name can be entered in the register which is evident from Sl.No.4 and the same is extracted hereunder:

4. Therefore, the impugned order in Na.Ka.No.20/ThaNaCMaMa/ 2024 dated 13.06.2024 passed by the 4th respondent is hereby quashed. The respondents are directed to consider the petitioner's representation in the light of the schedule as stated supra. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of the order.

5. With the above observations, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
