PRAYER :- For Anticipatory Bail in Crime No.178 of 2024 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.178 of 2024, for the offence punishable under Sections 8(c), 20(b)(ii)(B), 29(1) and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985, has filed this petition seeking anticipatory bail.
2. The allegation levelled against the petitioner is that the petitioner along with other accused was found in possession of 1.200kg. of ganja.
3. This is the 3rd anticipatory bail application. Considering the nature of allegations and also considering the fact that apart from this case, the petitioner was also involved in four previous cases, the earlier anticipatory bail applications were dismissed by this Court on 11.06.2024 and 14.10.2024. 2/4
4. Now, the petitioner has renewed this application that the petitioner's sister's marriage is scheduled in the month of January 2025. Considering the said submission, this Court, by order dated 20.12.2024, granted interim anticipatory bail to the petitioner for a period of ten days enabling him to perform the marriage function, however, with a condition that the petitioner shall file an affidavit of undertaking of a respectable person with an assurance that he will stand as a surety and execute a bond for a sum of Rs.1,00,000/-. However, the petitioner has not filed any such affidavit as per the earlier order of this Court dated 20.12.2024.
5. Considering the nature of allegation, antecedents and also considering his attitude, this Court is not inclined to extend the interim anticipatory bail. Moreover, the petitioner has made an averment that his sister's marriage is scheduled in the month of January 2025, but, he has not produced any materials for the same. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. 3/4
