ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for 1/3

the alleged offences under Sections 303(2) of BNS r/w. Section 21(4) of Mines and Minerals (Development Regulation) Act, 1957, in Crime No. 989 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The accused persons were found in possession of 40 bags of river sand measuring half a unit. There are 2 accused persons in this case and the petitioner has been arrayed as A1.

3. The learned Government Advocate (Criminal Side), on instructions, submitted that there are 28 previous cases against the petitioner, out of which, 10 cases are similar in nature.

4. Taking into consideration the facts and circumstances of the case and considering the previous cases against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this criminal original petition is dismissed.
