ORDER
The Criminal Miscellaneous Petition has been filed seeking orders to modify the condition imposed in Crl.M.P(MD)No.11725 of 2024 in Crl.R.C(MD)No.1066 of 2024 in Crl.R.C(MD)No.1066 of 2024, dated 04.11.2024, wherein this Court directed the petitioner to deposit 50% of the cheque amount/compensation amount within a period of four weeks from the date of receipt of copy of that order. 1/3

The learned counsel for the petitioner would submit that the petitioner has deposited 20% of the compensation amount before the trial Court, but they have failed to mention the same before this Court at the time of admission. He would further submit that the petitioner may be directed to deposit the amount less 20% of the amount already deposited.
3.But the learned counsel for the respondent would submit that they have not mentioned about the deposit made before the appellate Court and this Court has rightly directed the petitioner to deposit 50% of the amount.
4. Considering the facts and circumstances of the case and taking note of the submissions made on either sides, the petitioner is directed to deposit 50% of the balance amount (ie., Rs.1,20,000/- Rupees One Lakh Twenty Thousand Only) to the credit of S.T.C.No.15 of 2022 on the file of the Judicial Magistrate (Fast Track Court), Thanjavur, on or before 20.02.2025.
