PRAYER :- For Anticipatory Bail in Crime No.403 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for 1/3

the offence punishable under Section 303(1) of BNS, 2023 and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.403 of 2024, seeks anticipatory bail.

2. The accused persons is said to have carried 1⁄4 unit of river sand in bullock cart.

3. The learned Government Advocate submitted that there are totally 9 previous cases against the petitioner, out of which, 6 cases pertains to cases of similar nature. The list of cases were also produced before this Court. As early as in the year 2021 itself, the petitioner was involved in 2 cases of similar nature.

4. Taking into consideration the facts and circumstances of the case and considering the previous cases against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this criminal original petition is dismissed.
