PRAYER :- For Anticipatory Bail in Crime No.534 of 2022 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for 1/4

the alleged offence under Sections 8(c), 20(b)(ii)(B) of the NDPS Act and Section 489C of the IPC, in C.C.No.1095 of 2023, seeks anticipatory bail.

2. The petitioner is arrayed as an accused in C.C.No.1095 of 2023, on the file of the learned District and Sessions Court for EC and NDPS Act Cases, Madurai, for the offences punishable under Sections 8(c), 20(b)(ii)(B) of the NDPS Act and Section 489C of the IPC.

3. The petitioner was absent during the trial in C.C.No.1095 of 2023, on the file of the learned District and Sessions Court for EC and NDPS Act Cases, Madurai. Therefore non bailable warrant came to be issued on 10.09.2024.

4. The learned Additional Public Prosecutor submitted that there are totally 10 accused persons in this case and the petitioner has been arrayed as A5 and there is 1 previous case registered in crime no.298 of 2022 for possession of ganja.

5. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned learned District and Sessions Court for EC and NDPS Act Cases, Madurai, within a period of two weeks from the date of receipt of a copy of this order and file a petition to recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits.
