PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to settle the interest at the rate of 6 % per annum for the belated payment of petitioner's terminal benefits including Gratuity, Provident Fund, Earned Leave Salary, Surrender Leave Salary and RBSR amount from the date of the petitioners retirement to till the date on which the said benefits were settled to him, within the time frame fixed by this Court.

ORDER

The instant writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a mandamus directing the respondents to pay interest at the rate of 6% per annum for the belated payment of petitioner's terminal benefits.

According to the learned Counsel appearing for the writ petitioner, the petitioner was appointed in the respondent Transport Corporation on 21.04.1993, and he had attained superannuation on 31.01.2023. The terminal benefits were disbursed belatedly to the writ petitioner only after 21 months. Hence, he sent a representation on 25.11.2024, seeking interest for the belated payment. Since, there is no response from the respondents authorities, the present writ petition has been filed.

3. Considering the above said facts, the respondent Transport Corporation is directed to pay interest at the rate of 6% from the due date till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
